Public offer

This contract between MATIEK YULIYA SERGEEVNA, hereinafter referred to as the “Seller” and the user of the website’s services, hereinafter referred to as the “Customer”, is an order contract for ordering, purchasing and delivering goods and defines the basic conditions for ordering, purchasing and delivering goods via the Internet site https://matique.com.ua/. The buyer, acting for the purpose of purchasing goods, accepts the terms of this sales contract, hereinafter referred to as the "Contract", of the goods under the following conditions.

1. DEFINITION OF TERMS

1.1. Public Offer (hereinafter referred to as the “Offer”) is the Seller’s public offer, addressed to an indefinite number of persons, to conclude with the Contract the terms and conditions contained in this Offer, including all annexes.

1.2. Order - the decision of the Customer to order the goods and their delivery, drawn up in the online store and / or orders for the purchase and delivery of goods.

1.3 Goods - models, accessories, components and accompanying items.

1.4 Acceptance - the full, unconditional and unconditional acceptance of the Offer of this Agreement.

1.5 Online store - in accordance with the Law of Ukraine "On e-commerce", a means for the presentation or sale of goods, works or services by making an electronic transaction.

2. GENERAL PROVISIONS

2.1. The information below is the official offer of the online store https://matique.com.ua to the Customer to conclude a public Contract, the terms of which, according to Article 633 of the Civil Code of Ukraine are the same for everyone.

2.2. According to Article 642 of the Civil Code of Ukraine, the complete and unconditional acceptance of the terms of this offer (offer), which confirms the conclusion of the Contract on the conditions proposed below, is the fact of placing and confirming an order.

2.3. By ordering, the Customer confirms his unconditional acceptance of the terms of this offer (offer).

2.4. By concluding the Contract (that is, by accepting the terms of this Offer by placing an Order), the Customer confirms the following:

a) the Customer is fully and fully acquainted with and agrees with the terms of this Offer;
b) he gives permission for the collection, processing and transfer of personal data under the conditions defined below in the Caution on the collection, processing and transmission of personal data permission for the processing of personal data, is valid for the entire duration of the Agreement, as well as for an unlimited period his actions. In addition, by concluding the Agreement, the Customer confirms that he has been notified (without additional notification) of the rights established by the Law of Ukraine "On the Protection of Personal Data", of the purpose of data collection, and that his personal data are transferred to the Seller in order to be able to of this Agreement, the possibility of mutual settlements, as well as for receiving invoices, acts and other documents. The Customer also agrees that the Seller has the right to provide access and transfer its personal data to third parties without any further notification of the Customer, without changing the purpose of processing personal data. The scope of the rights of the Customer, as a subject of personal data according to the Law of Ukraine "On the protection of personal data" is known and understandable to him.

3. PRICE OF GOODS

3.1. The price for each item of the Goods is listed on the website of the online store.

3.2. The seller has the right to unilaterally change the price of any position of the Goods.

3.3. In the event of a change in the price of the ordered Goods, the Seller undertakes to inform the Customer.

3.4. The Customer has the right to confirm or cancel the Order for the purchase of Goods, if the price is changed by the Seller after placing the Order.

3.5. Change by the Seller of the price of the Goods paid by the Customer is not allowed.

3.6. The seller indicates the cost of delivery of the goods on the website of the online store or informs the buyer when placing the order by the operator.

3.7. The Customer’s obligations to pay for the Goods shall be deemed fulfilled from the moment the funds are received by the Seller.

3.8. Payments between the Seller and the Customer for the Goods are made by the methods indicated on the website of the online store in the section "ORDER RULES AND DELIVERY".

4. ORDERING

4.1. Ordering of Goods is carried out by the Customer through the Operator by phone: + 38 (098) 817 78 70 or through the service of the online store site https://matique.com.ua/

4.2. When registering on the website of the online store, the Customer undertakes to provide the following information:

4.2.1. surname, name, patronymic of the Customer or the person (recipient) specified by him;

4.2.2. the address to which the goods should be delivered (if the delivery is to the address of the customer);

4.2.3. E-mail address;

4.2.4. contact number.

4.3. The name, quantity, article, price of the Goods selected by the Customer shall be indicated in the Customer’s basket on the Online Store website.

4.4. If the Seller needs additional information, he is entitled to request it from the Customer. In the case of not providing the necessary information by the Customer, the Seller is not responsible for providing quality services to the Customer when purchasing goods in the online store.

4.5. When placing the Order through the operator (clause 4.1. Of this Offer), the Customer undertakes to provide the information specified in clause 4.2. this Offer.

4.6. Acceptance by the Customer of the terms of this Offer is carried out by entering the Customer with the relevant data in the registration form on the website of the online store or when placing the Order through the operator. After placing the Order through the operator, the data about the Customer is registered in the database of the Seller.

4.7. The customer is responsible for the accuracy of the information provided when ordering.

4.8. The contract by remote method between the Seller and the Customer is considered to be concluded from the moment of electronic ordering on the service of the website of the online store or when the Seller issues a cash or sales receipt or other document confirming payment for the Goods to the Customer.

5. DELIVERY AND TRANSFER OF GOODS TO THE BUYER

5.1. Ways, order and delivery of goods are listed on the website in the section "ORDER RULES AND DELIVERY". The order and conditions of delivery of the ordered goods The customer coordinates with the operator of the online market at the time of purchase.

5.2. Delivery of goods is carried out on its own by employees of the online store according to the terms of delivery, or with the involvement of third parties (carrier).

5.3. Upon receipt of the goods, the Customer must, in the presence of the courier’s representative, verify the compliance of the Goods with the qualitative and quantitative characteristics (product name, quantity, completeness, shelf life).

5.4. When accepting goods, the Customer or the Customer’s representative confirms with his signature in the sales receipt and/or order for delivery of goods that he has no complaints about the quantity of the Goods, appearance and completeness.

6. RETURN OF GOODS

6.1. The customer has the right to refuse the non-excisable goods at any time prior to its transfer, and after the transfer of the non-excisable goods - in the manner and on the conditions determined by the Law of Ukraine "On Protection of Consumer Rights".

6.2. Return of a non-exempted product of the proper quality is possible in case its merchandise, consumer properties, as well as a document confirming the fact of purchase and the conditions of ordering the indicated Goods within 14 days from the day following the purchase, are preserved.

6.3. The customer is not entitled to refuse the goods of good quality, which was sold on outlet sales or has individually-defined properties, if the specified goods can be used exclusively by the customer who purchased it (including non-standard, at the request of the customer, dimensions, etc.). Confirmation that the product has individually-defined properties is the difference in the size of the goods and other characteristics that are indicated in the online store.

6.4. Return of Goods, in cases stipulated by the law and this Agreement, is carried out through the Internet-shop, after the Buyer's request to the manager of the Internet store through the electronic mail or by telephone indicated on the site.

6.5. If the Customer refuses from a non-excisable good quality product, the Seller returns the money in the amount of the cost of such Goods, except for the seller’s expenses for the delivery of the goods, which are returned.

6.6. Return of the amount specified in clause 6.5. carried out simultaneously with the return of the goods.

7. RESPONSIBILITY OF THE PARTIES

7.1. The Seller shall not be liable for damage caused to the Customer due to improper use of the Goods pre-ordered on the site https://matique.com.ua/ and purchased from the Seller.

7.2. The Seller shall not be liable for the inadequate, untimely fulfillment of Orders and their obligations in the event that the Customer provides false or false information.

7.3. The seller and the customer are responsible for meeting their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.

7.4. The Seller or Customer is relieved of liability for full or partial failure to fulfill its obligations if the failure is the result of force majeure circumstances such as war or hostilities, earthquake, flood, fire and other natural disasters that occurred regardless of the Seller’s will and / or Customer after the conclusion of this Agreement. A party that cannot fulfill its obligations shall immediately notify the other party.

8. TERM OF OFFER

8.1. This Offer takes effect from the moment of its placement on the website of the online store and is valid until the moment of its withdrawal by the Seller.

8.2. The Seller has the right at any time to amend the terms of the Offer and/or withdraw the Offer at any time at its discretion. In the event that the Prodvme makes changes to the Offer, such changes take effect from the moment of posting the modified text of the Offer on the website of the Online Store, unless a different date of entry into force of the changes is specified directly in the text of the modified Offer.
